Intellectual Property Litigation

Dorman Bell’s Intellectual Property Litigation practice consists of the prosecution and defense of claims of intellectual property infringement.  This includes litigating rights regarding patents, trademarks, service marks, trade dress, trade secrets, and copyrights.  We are experienced litigating claims of unfair competition as well as antitrust violations.  We also provide services in structuring, drafting, and negotiating intellectual property and e-commerce transactions.  Our attorneys assist clients with intellectual property licensing, technology transfer agreements, service agreements, software licensing, marketing and distribution arrangements, as well as employment agreements designed to protect a company’s intellectual property.  In addition, we have substantial experience with e-commerce and internet-related transactions, including agreements for web site development and hosting, co-branding, Internet-based services, and content licensing.

Intellectual Property Procurement

The members of our Intellectual Property Procurement practice are registered to practice before the United States Patent and Trademark Office.  We have extensive experience in the preparation and prosecution of applications for patents, trademarks, and copyrights in the United States.  While we are experienced in protecting mechanical and electrical inventions, the technical backgrounds or our professionals provide special expertise in the area of software development and engineering.

IP Portfolio Management and Counseling

Dorman Bell regularly counsels clients concerning their intellectual property rights as part of its Intellectual Property Portfolio Management and Counseling practice.  Such counseling includes reviewing a company’s products and business processes for possible patent, trademark, or copyright protection, as well as rendering opinions on patent validity and infringement and on trademark and service mark infringement and registration.  We also provide advice on the selection, design, and use of trademarks and service marks, and recommendations on the protection of inventions, trade secrets, and copyrightable subject matter.

Commercial Litigation

Our Commercial Litigation practice includes the prosecution and defense of lawsuits in state and federal courts, as well as the representation of clients in arbitration, mediation, and other alternative dispute resolution procedures. We have experience representing clients in a multitude of mediation settings as well as before the National Arbitration Forum.

Software License Audit Defense

Dorman Bell is one of only a few law firms in the nation that has a dedicated practice area for Software License Audit Defense, helping companies defend themselves against software license audits from software publishers and their trade organization, such as the Business Software Alliance and the Software and Information Industry Association.
