Software License Audit Defense

The cases below are representative of our experience and the results we have achieved for our clients.  However, past performance is no guarantee of future results. Every case is different. The results obtained in your particular case depend heavily on the facts of your particular case. Similar results to those mentioned below may not be obtained in your case.

Our client, a prominent information technology services company, was accused by the Business Software Alliance of copyright infringement and asked to conduct a software license audit or face litigation.  After assisting our client conduct a self-audit of the software installed on its network, and helping our client optimize their available software licenses with the help of an experienced software license audit company, we presented the results of the audit to the Business Software Alliance.  After receiving a demand for minimal damages based on the results of the software license audit, we were able to negotiate a final settlement that included no monetary award.  Other terms were provided in a confidential settlement agreement.

We represented an architecture company that was accused by the Software and Information Industry Association of software piracy and was asked to conduct a software license audit or face a copyright infringement action.  With the help of an experienced software license audit company, we were able to conduct a thorough investigation that demonstrated no illicit software on our client’s network.  After presenting the results of the software license audit to the Software and Information Industry Association, the matter was dropped.

Our client, a leader in the financial services industry, was asked by a major software publisher to conduct a software license audit.  After assisting our client conduct a self-audit of the software installed on its network, and helping our client optimize their available software licenses, we presented the results of the audit to the software publisher.  Upon acceptance of the results, we were able to negotiate a settlement where our client only needed to purchase the number of software licenses for which the software license audit showed a shortage.  Other terms were provided in a confidential settlement agreement.
